The team at Wonder Makers has been working actively through both the RIA and IAQA to offer input to the Department of Labor in regards to New York’s new mold law. Although there were various options that were discussed during the rule making process that would have allowed a short term “grandfathering” of individuals who had received recent training from nationally recognized vendors, that approach did not make it into the recently published rules.
Indeed, once the rules were finalized our experts reviewed the new law and spoke with the program officials. According to the information that we received from Mr. Chek Ng, the State of New York has not accepted any previous training to qualify under the new law. This means that the advertisements/announcements recently publicized by some national training providers that their training was acceptable under the new law is erroneous. In fact, the State of NY is requiring every training provider become licensed before they can offer training.
Based on the revisions that we are completing to our class presentation, there is somewhere between 4-8 hours of new material in the three day class as compared to the training that Wonder Makers typically offers to supervisors. In order to meet the requirements of the New York regulations the entire three days had to be reformatted to comply with the very specific requirements for the training. At this point, Wonder Makers is only submitting an application to provide supervisor training (known in the regulations as Mold Remediation Specialist); not the worker training. Depending on the response and demand, the license to provider worker training may follow.
The team at Wonder Makers has worked diligently to assemble the reams of information required under the new regulations. Given that the application for training providers was just released on July 30, we are hoping to be one of the first approved training providers. The regulations require the state to approve or deny the training application within 30 days of receipt. Mr. Ng seemed to think that it would go quicker than that because they realize that they are putting companies and training providers behind the eight ball to complete all of the necessary training prior to January 1.
As soon as we receive our license, we will begin scheduling classes. We are extremely disappointed that the State did not move through with their additional plan to temporarily grandfather in any training (even if they wanted to add a one day State of New York new rules update; which they also chose not to do). Nevertheless, we will endeavor to provide the best training possible for all of our customers and clients who provide mold remediation services in New York.

This decision not to grandfather goes against the PR blitz that NY is a friendly state to do business in and offers incentives like no corporate taxes etc.
This is a step in the wrong direction.

I agree Jack.
